**Terms and Conditions for BE SMARTER Mobile Vehicle Smart Repair Services**
1. **Introduction**
1.1. These terms and conditions govern the provision of mobile vehicle smart repair services ("Services") provided by BE SMARTER ("we", "us", "our") to you, the customer ("you", "your"), and are in accordance with the Consumer Rights Act 2015 and other relevant UK legislation.
1.2. By ordering Services from us, you agree to be legally bound by these terms and conditions.
2. **Provision of Services**
2.1. We will supply the Services to you using reasonable care and skill as per the Consumer Rights Act 2015.
2.2. We will provide the Services in accordance with the information provided by you. It is your responsibility to ensure that this information is accurate and complete.
2.3. We reserve the right to decline to provide Services where it would be unsafe, unlawful, or unreasonably difficult to do so, or where the condition of your vehicle/property may affect the quality or safety of the work.
3. **Booking and Cancellation**
3.1. Bookings for our Services can be made through various channels including, but not limited to, telephone, email, or our website.
3.2. We may require a deposit to secure your booking. The terms regarding the deposit, including whether or not it is refundable, will be communicated to you at the time of booking.
3.3. You have the right to cancel your booking at any time. If you cancel at least 48 hours before the scheduled service, any deposit paid may be returned to you. Cancellations made within 24 hours may result in the loss of your deposit.
4. **Pricing and Payment**
4.1. The price of the Services will be provided to you at the time of booking. Any changes to the price, due to additional work required or unforeseen circumstances, will be discussed and agreed upon before the work proceeds.
4.2. Payment is due upon completion of the Services. We accept various payment methods, which will be indicated at the time of booking or invoicing.
5. **Guarantee** (Vehicle SMART repairs only)
5.1. We offer a Lifetime Repair Warranty on all vehicle repair work carried out by BE SMARTER. This warranty is limited to the entire lifetime of your ownership of the vehicle on which the repair work was performed only, subject to the terms and conditions outlined herein.
5.2. The Lifetime Repair Warranty is under no circumstances transferable to any new owner of the vehicle following the repair being completed.
5.3. The Lifetime Repair Warranty covers the quality of workmanship and materials used in the repair, subject to the usual conditions and exclusions.
5.4. The guarantee does not cover damage resulting from normal wear and tear, misuse, neglect, or subsequent accidents.
5.5. Where a previous repair has been carried out on your vehicle by someone else or another business before us undertaking further repair work, no warranty shall be provided by us. This will be discussed at the time of booking.
5.6. To submit a claim under the Lifetime Repair Warranty, please email us at info@besmarter.uk with the required information. We will review your claim and work with you to resolve the issue in line with the terms of the warranty.
5.7. Upon a valid guarantee claim, we will rectify the issue at no additional cost to you. If we are unable to rectify the issue, we may offer a partial or full refund at our discretion.
5.8. Aftercare information will be provided along with your invoice. Failure to follow the aftercare advice will result in a complete void of any warranty.
6. **Other and Bespoke Services**
6.1. In addition to our SMART vehicle repair services, we also offer other services such as Headlight restoration, boat paint repairs, uPVC door and window colour changes, kitchen cupboard respray/colour changes and other bespoke services.
6.2. Warranty terms for other and bespoke services will be limited and advised at the time of quoting for the work.
6. **Liability**
6.1. Our liability for any loss or damage as a result of our failure to comply with these terms and conditions is strictly limited to the purchase price of the Services you purchased.
6.2. We are not liable for losses not caused by our breach or negligence, for indirect losses which are a side effect of the main loss or damage, or for failure to provide the Services or to meet any of our obligations under these terms and conditions where such failure is due to events beyond our control (force majeure).
6.3. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the Services.
6.4. If we fail to comply with these terms and conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable.
7. **Your Responsibilities**
7.1. You are responsible for making the vehicle available at the scheduled time and place for the Services to be provided and for ensuring that the vehicle is in a condition that allows us to perform the Services.
7.2. You must inform us of any special requirements or considerations in advance of the service.
7.3. You are responsible for the removal of any personal items from the vehicle before the start of the Services. We will not be responsible for any loss or damage to personal items left in the vehicle during the provision of Services.
8. **Complaints and Dispute Resolution**
8.1. If you have a complaint about the Services, you should contact us as soon as possible to allow us the opportunity to investigate and rectify your concerns.
9. **Governing Law and Jurisdiction**
9.1. These terms and conditions are governed by and construed in accordance with the laws of England and Wales.
9.2. Any disputes or claims arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
10. **Changes to the Terms and Conditions**
10.1. We may need to revise these terms and conditions from time to time to reflect changes in relevant laws and regulatory requirements or improvements in our Services.

12.2. By providing your personal data to us, you consent to the processing of your data as described in our Privacy Policy, which includes, but is not limited to, using your data to fulfil the Services we provide to you and for internal record-keeping purposes.
12.3. We will take all reasonable precautions to keep your personal details secure and will not disclose them to third parties, except as necessary to provide the Services or as required by law.
13. **Intellectual Property**
13.1. All intellectual property rights in or arising out of or in connection with the Services shall be owned by us.
13.2. You agree not to infringe any intellectual property rights in the course of using our Services.
14. **Third-Party Rights**
14.1. These terms and conditions are between you and us. No other person shall have any rights to enforce any of its terms, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
15. **Severability**
15.1. Each paragraph of these terms and conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
16. **Waiver**
16.1. If we do not insist immediately that you do anything you are required to do under these terms and conditions, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
This document sets out the full extent of our obligations and liabilities in respect of the supply of Services. Your statutory rights as a consumer are not affected in any way. In the event of any conflict between these terms and conditions and your statutory rights, your statutory rights will prevail.
